ViralFactory ("we", "us", or "our") operates the ViralFactory platform. This Privacy Policy explains what information we collect, how we use it, and your rights regarding your data.

1. Information We Collect

Account information. When you sign up we collect your email address and, optionally, your name via Clerk authentication.

Usage data. We store the characters, content, and launch packs you create, along with generation logs needed to operate the service and calculate credit usage.

Payment data. Card and other non-crypto payments are processed by Dodo Payments, our merchant of record, which collects your billing details and payment credentials directly — we never see or store your card number. Cryptocurrency payments are processed by NOWPayments. In both cases we store only the transaction status, order reference, subscription status, and credit amount. We never store wallet addresses, private keys, or full payment credentials.

Instagram connection. If you connect an Instagram account we store the access token and account metadata required to publish content on your behalf. We do not store your Instagram password.

2. How We Use Your Information

• To provide, operate, and improve the ViralFactory platform.
• To process payments, manage subscriptions, and credit your account after confirmation.
• To generate AI content and characters using the prompts and inputs you supply.
• To send transactional communications related to your account (e.g. payment receipts).

3. AI-Generated Content

Content you create using ViralFactory is processed by third-party AI providers (including Atlas Cloud and xAI). Your prompts and reference images are transmitted to these providers solely to fulfill your generation requests. We do not sell your inputs to third parties.

4. Data Sharing

We do not sell your personal data. We share data only with the service providers necessary to operate ViralFactory (authentication, AI generation, payment processing, cloud storage, and database hosting). Each provider is bound by its own privacy policy.

5. Data Retention

We retain your account data for as long as your account is active. Generated images are stored in cloud storage and may be deleted upon account deletion. Payment records are kept for accounting and compliance purposes.

6. Data Security

Your data is stored with reputable cloud providers and protected by encryption in transit, access controls, and authentication via Clerk. No method of transmission or storage is 100% secure, but we take commercially reasonable measures to protect your information.

7. International Transfers

Our service providers may process data in countries outside your own, including the United States. Where required, transfers rely on appropriate safeguards such as standard contractual clauses maintained by those providers.

8. Your Rights

Depending on where you live (including under the GDPR and similar laws), you may have the right to access, correct, export, restrict the processing of, or delete your personal data, and to object to certain processing. You can exercise these rights at any time by contacting us at the address below; we respond within the timeframe required by applicable law. Account deletion removes your profile and associated content from our active systems. You also have the right to lodge a complaint with your local data-protection authority.

9. Cookies

We use strictly necessary cookies for authentication sessions. Dodo Payments may set cookies during checkout to process your payment and prevent fraud. We do not use advertising or tracking cookies.

10. Children

ViralFactory is not directed at children under 18. We do not knowingly collect data from minors.

11. Changes to This Policy

We may update this policy from time to time. Material changes will be communicated via the platform or by email. Continued use of the service after changes constitutes acceptance.
